The United States District Court for the Eastern District of California ruled in favor of Arias Sanguinetti clients Sara Granda and Jose Granda in a groundbreaking temporary restraining order against California Public Employees’ Retirement System (CalPERS). Sara was left with no recourse but to pursue legal action when CalPERS refused to provide her with the life-saving care that she needs. In refusing to pay for Sara’s necessary and urgent medical care, CalPERS failed to fulfill its obligation as her insurer and placed her life in extreme danger. Thanks to this ruling, Sara will receive the immediate care she needs and deserves.
Our team is proud to see Sara get justice. Sara is a quadriplegic who is fully ventilator dependent with no ability to breathe on her own. Her disability requires 24-hour skilled nursing care and due to her disability, she is perpetually at high risk for life threatening medical complications if not provided appropriate care. Despite her complex medical needs, Sara worked her way through law school and has been a practicing attorney for over 10 years. Sara herself works every day to see that Californians get the healthcare they deserve as a part of the team at the California Department of Healthcare Services. Sara is a quadriplegic and requires preventative care. With CalPERS compelled to fulfill its obligation, she can look forward to better to life saving care as she continues her work for the people of California.
CalPERS’ refusal to fulfill its obligation to Sara is yet another example of its broad-scale bad faith practices. In 2023, CalPERS agreed to pay $800 million to long-term care plan members after it raised their premiums far beyond the inflation-protected rates specified in their plans. Due to these rate hikes, thousands of hard-working Californians were functionally expelled from plans that they had spent decades paying into.
